Original artwork and wording are the heart of a print-on-demand shop, and we know how much work goes into a good design. We respect the copyrights of artists, writers, illustrators and photographers, and we expect the same respect for our own work. This page follows the notice-and-takedown process of the United States Digital Millennium Copyright Act (DMCA) and applies to anyone, wherever they are, who believes their copyright has been infringed on our site.</p>\n<h2>1. What this page covers</h2>\n<p>This process covers <strong>copyright</strong>: rights in original creative works such as illustrations, graphic designs, photographs, written text, typography artwork and similar material. On kinfolktee.com, that could include:</p>\n<ul>\n<li>a design printed on one of our tees, sweatshirts, hoodies or mugs;</li>\n<li>a product photo, mock-up or banner image;</li>\n<li>text in a product description, category page or blog post;</li>\n<li>content submitted by customers, such as review photos.</li>\n</ul>\n<p>It does not cover trademarks (names, logos, slogans used as brands), personal publicity rights or other disputes. Those are handled under our <a href=\"/intellectual-property-policy/\">Intellectual Property Policy</a>. If you are unsure which applies, write to us anyway and we will route your message.</p>\n<h2>2. Before you send a notice</h2>\n<p>Many family phrases and common sayings are not protected by copyright on their own; short phrases, titles, common symbols and simple shapes are generally not copyrightable, although an original artwork built around them may be. Fair use and similar doctrines can also allow some uses without permission. We encourage you to consider whether the use of your work could be lawful before sending a formal notice, and to seek legal advice if you are unsure. Sending a notice that you know to be false can make you liable for damages (see section 6).</p>\n<p>If you would simply like to talk to us first, for example because you think one of our designs resembles yours by coincidence, an informal email is welcome. Many concerns are resolved quickly that way.</p>\n<h2>3. How to send a copyright notice</h2>\n<p>Send your notice by email to <a href=\"mailto:support@kinfolktee.com\">support@kinfolktee.com</a> with &#8220;Copyright notice&#8221; in the subject line. To be complete under the DMCA, your written notice must include:</p>\n<ol>\n<li>a physical or electronic signature of the copyright owner or a person authorised to act on their behalf;</li>\n<li>identification of the copyrighted work you believe has been infringed, or a representative list if several works are involved, ideally with a link to or copy of the original;</li>\n<li>identification of the material you believe is infringing, with enough information for us to find it, such as the full URL of the product page and a description of the design or image;</li>\n<li>your contact information: name, postal address, telephone number and email address;</li>\n<li>a statement that you have a good faith belief that the use of the material is not authorised by the copyright owner, its agent or the law;</li>\n<li>a statement that the information in the notice is accurate and, under penalty of perjury, that you are the copyright owner or authorised to act on the owner&#8217;s behalf.</li>\n</ol>\n<p>Notices missing any of these elements may delay our response. What we do when we receive a notice</h2>\n<ol>\n<li><strong>Acknowledge:</strong> we confirm receipt within 1 business day.</li>\n<li><strong>Review:</strong> we check that the notice is complete and identify the material.</li>\n<li><strong>Act:</strong> if the notice is complete, we promptly remove or disable access to the identified material. For a product, that usually means unpublishing the product page and stopping production of that design.</li>\n<li><strong>Notify:</strong> if the material was submitted by someone else, such as a customer review photo, we tell that person it was removed and give them a copy of the notice so they can respond.</li>\n<li><strong>Follow up:</strong> we let you know what action we took.</li>\n</ol>\n<p>Orders already printed and in transit before we received your notice may still be delivered to customers. Once a complete notice is received, we do not start production of further units of the identified design while the matter is open.</p>\n<h2>5. Counter-notification for content that was removed</h2>\n<p>If content you submitted was removed and you believe that happened because of a mistake or misidentification, you may send us a counter-notification at <a href=\"mailto:support@kinfolktee.com\">support@kinfolktee.com</a> with &#8220;Counter-notification&#8221; in the subject line. It must include:</p>\n<ul>\n<li>your physical or electronic signature;</li>\n<li>identification of the material that was removed and where it appeared before removal;</li>\n<li>a statement under penalty of perjury that you have a good faith belief the material was removed as a result of mistake or misidentification;</li>\n<li>your name, address and telephone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or, if your address is outside the United States, any judicial district in which Kin Folk Tee may be found), and that you will accept service of process from the person who sent the original notice or their agent.</li>\n</ul>\n<p>We forward valid counter-notifications to the person who sent the original notice. We may restore the material in 10 to 14 business days unless they tell us they have started court proceedings to restrain the alleged infringement.</p>\n<h2>6. False or misleading notices</h2>\n<p>Under the DMCA, anyone who knowingly makes a material misrepresentation that material is infringing, or that it was removed by mistake, may be liable for damages, including costs and attorneys&#8217; fees. Please make sure your notice or counter-notification is accurate. We may decline to act on notices that appear to be abusive, for example notices sent to remove competitors&#8217; lawful content.</p>\n<h2>7. Repeat infringement</h2>\n<p>Where customers or contributors submit content to our site, we may remove the content of, and end the accounts of, users who repeatedly infringe copyright, in appropriate circumstances.</p>\n<h2>8. How we work to avoid problems</h2>\n<p>We aim to sell only designs we created or have the right to use. Before a design goes live, we check that it does not reproduce known characters, sports team marks, brand logos, celebrity images or artwork found online. Our product photos and mock-ups are created for us or licensed for our use. Nobody is perfect, and if something slipped through, we want to know and fix it quickly.</p>\n<h2>9. Our own work</h2>\n<p>Kin Folk Tee designs and photographs are protected by copyright too. If you find our designs or images copied on another website or marketplace, we would be grateful if you let us know at <a href=\"mailto:support@kinfolktee.com\">support@kinfolktee.com</a>. If you want to use one of our images, for example in a blog post or a gift guide, please ask first; we are often happy to say yes with a credit link.</p>\n<h2>10. A note for customers</h2>\n<p>If you bought a product that is later removed because of a copyright notice, your purchase is not affected. You may keep it, and our normal 60-day <a href=\"/returns-exchanges-policy/\">returns</a> still apply. If a design you ordered can no longer be printed because of a notice received before production, we will tell you and refund that item in full within 7 calendar days.</p>\n<h2>11. Notices about images versus designs</h2>\n<p>It helps us to know exactly what you believe is copied. A product page can contain several separate elements: the printed design itself, the wording in the design, the product photo or mock-up showing the garment, and the written description. If your concern is about a photo, we can replace that photo without touching the design; if it is about the design, the whole product is affected. Please be as specific as you can, for example &#8220;the illustration of the porch swing on the front of the tee&#8221; or &#8220;the second gallery image&#8221;, so that we remove what is actually at issue and nothing else.</p>\n<p>If you represent several artists or own a large catalogue, you can list multiple works in one notice. A simple table with your work in one column and the matching product URL in the next is easiest for us to act on quickly and accurately.</p>\n<h2>13. Other ways to reach us</h2>\n<p>Email is the fastest route.
